What Is Withholding of Removal?

This protection is granted by an Immigration Judge when your life or freedom would be threatened due to:

  • Race

  • Religion

  • Nationality

  • Political opinion

Although it does not lead to permanent residency, it allows you to remain in the U.S. and apply for a work permit. This protection is only for you and cannot be extended to family members.

  • Cannot be deported to the country where torture is likely

  • May be eligible for a work permit

  • Do not gain permanent residency or the right to bring family
